This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website and services (collectively, the "Service"), which involve the generation of video, images, and audio using artificial intelligence (AI). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the Service.

VosuAI does not perform facial recognition, biometric identification, or identity verification using uploaded images or videos.

1. Information We Collect

We may collect information about you in a variety of ways. The information we may collect via the Service includes:

  • Personal Data: Personally identifiable information, such as your name, email address, and payment information, that you voluntarily give to us when you register for the Service or when you choose to participate in various activities related to the Service.
  • Input Data: Information, prompts, text, images, or other data you provide to the Service for the purpose of generating AI videos, images, audio, and related creative outputs ("Input Data"). Photos you upload may depict faces; we treat such content as part of Input Data for the features you choose, not as a separate biometric enrollment.
  • Face Data (Photos Containing Faces): When you use our character creation feature, you upload photos that may contain your face. From these photos, our AI service providers extract visual descriptors such as approximate age range, hair style, eye color, face shape and appearance, skin tone, body type, and expression. These descriptors are used solely to generate AI character models that visually resemble you. We do not extract or store biometric identifiers (such as facial geometry, faceprints, or iris scans), and we do not perform facial recognition or identity verification.
  • Generated Content: The videos, images, audio, and other outputs generated by our AI based on your Input Data ("Generated Content").
  • Derivative Data: Information our servers automatically collect when you access the Service, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Service.
  • Usage Data: Information about how you use the Service, including the features you use, the frequency and duration of your activities.

2. Use of Your Information

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Service to:

  • Create and manage your account.
  • Provide, operate, and maintain our Service.
  • Process your Input Data to generate the requested AI videos, images, audio, and other outputs you ask for.
  • When you use uploading or generation features, process your content only to operate those features for you, in line with this Policy and any in-product notices we show where required.
  • When you use the character creation feature, transmit your uploaded photos (which may contain faces) to Anthropic (Claude) for quality validation and visual analysis, and to our AI image generation infrastructure providers for creating character variations. These providers process your photos solely to deliver the feature you requested. Before your photos are sent, you will be shown an in-app disclosure identifying these providers and asked for your explicit consent.
  • Improve, personalize, and expand our Service. We do NOT use your Input Data or Generated Content to train our AI models.
  • Understand and analyze how you use our Service.
  • Process your transactions and manage your orders.
  • Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the Service, and for marketing and promotional purposes.
  • Send you emails.
  • Find and prevent fraud.
  • Comply with legal obligations.

We do not use Input Data or Generated Content to train our AI models unless you provide explicit consent where such an option is made available.

3. Disclosure of Your Information

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

  • By Law or to Protect Rights: If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.
  • Third-Party AI Service Providers: To provide AI-powered features, we transmit certain Input Data (including uploaded photos that may contain faces, text prompts, and images) to the following third-party AI service providers:
    • Anthropic (Claude) – Receives uploaded photos for quality validation and visual analysis (extracting descriptors such as age, hair, eye color, face appearance, skin tone). Used during character creation and photo validation.
    • AI Generation Infrastructure Providers – Receive text prompts and reference images for AI image and video generation, including character model variations. These infrastructure partners route requests to the appropriate AI models on our behalf.
    • OpenAI – Receives text prompts for content generation, prompt enhancement, and video generation features (including Sora where available).
    • Google APIs – May receive text and image data for AI processing and generation features.
    • RunwayML – Receives prompts and images for video generation features.
    • Luma AI – Receives prompts and images for video and 3D generation features.
    • Kling AI (Kuaishou) – Receives prompts and images for video generation features.
    • World Labs – Receives prompts and images for 3D scene generation features.

    Each provider processes your data solely to generate the output you requested. We contractually require these providers to protect your data and not use it for their own training or other purposes beyond fulfilling your request. The specific providers used depend on which features you use. The app will identify the relevant provider(s) and obtain your consent before transmitting your data.

  • Cloud Infrastructure Providers: We use Amazon Web Services (AWS) as our primary cloud hosting and storage provider. Your uploaded photos and generated content are stored on AWS S3 servers in the United States. AWS maintains high security and privacy standards.
  • Other Service Providers: We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and analytics.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • With Your Consent: We may disclose your personal information for any other purpose with your consent.

We do not sell your personal information or Input Data.

3a. Face Data: Collection, Use, Sharing, and Retention

This section specifically addresses how VosuAI handles photos containing faces ("Face Data").

What Face Data We Collect

When you use the character creation feature, you voluntarily upload 4–10 photos of yourself. These photos may contain your face. From these photos, our AI service providers extract the following visual descriptors: approximate age range, hair style and color, eye color, face shape and general appearance, skin tone, estimated height, body type, ethnicity, and facial expression. These are general visual descriptions—not biometric identifiers. We do not extract faceprints, facial geometry measurements, iris scans, or any data that could be used for biometric identification.

How We Use Face Data

  • Photo Quality Validation: Each uploaded photo is sent to Anthropic (Claude) to check whether it meets quality requirements (resolution, lighting, clarity) for character model creation.
  • Visual Analysis: Your uploaded photos are sent to Anthropic (Claude) to extract visual descriptors (age, hair, eyes, face appearance, skin tone, etc.) that describe your physical appearance in text form.
  • Character Model Creation: The extracted visual descriptors and your reference photos are used to create an AI character model that visually resembles you.
  • AI Image Generation: Your reference photos and visual descriptors may be sent to our AI generation infrastructure providers to generate character variations and AI images based on your likeness.

We do not use your face data for facial recognition, biometric identification, identity verification, surveillance, advertising profiling, or any purpose other than providing the specific AI generation features you requested.

Who Receives Your Face Data

  • Anthropic (Claude) – Receives your uploaded photos for quality validation and visual descriptor extraction. Anthropic processes this data under its data processing terms and does not use your photos to train its models.
  • AI Generation Infrastructure Providers – Receive reference photos and visual descriptors for AI image generation. These providers process this data solely to generate the requested output and do not retain your data after processing.
  • Amazon Web Services (AWS) – Your uploaded photos and generated images are stored on AWS S3 servers in the United States.

No other third parties receive your face data. We do not sell, rent, or share your face data for advertising, analytics, or any purpose unrelated to providing the Service.

Where Face Data Is Stored

Your uploaded photos are stored on Amazon Web Services (AWS) S3 servers located in the United States. The extracted visual descriptors (text-based descriptions such as "brown hair, blue eyes") are stored in our database alongside your character model. During processing, photos are transiently held in memory on our AI service providers' servers and are not retained by those providers after processing is complete.

How Long Face Data Is Retained

  • Reference photos (uploaded images): Stored on AWS S3 for as long as your character model exists in your account. When you delete a character model, the associated reference photos are also deleted.
  • Temporary processing copies: During upload and analysis, compressed copies of your photos are held in server memory and are discarded immediately after analysis is complete. These copies are not persisted to disk.
  • Visual descriptors (text descriptions): Retained for as long as the associated character model exists in your account. Deleted when you delete the model.
  • Upload session data: Temporary upload sessions (pending photos before model creation) are automatically deleted once the character model is created or after 24 hours, whichever comes first.
  • Generated images: Stored for as long as your account is active. You may request deletion at any time by contacting [email protected].

You can delete your character models and all associated face data at any time from within the app. You may also contact us at [email protected] to request complete erasure of all your data.

Your Consent

Before your photos are sent to any third-party AI service provider, the app displays an in-app disclosure that clearly identifies:

  • What data will be sent (your uploaded photos containing faces)
  • Who will receive it (Anthropic for analysis, AI generation infrastructure providers for image creation, AWS for storage)
  • Why it is being sent (to validate photo quality, extract visual descriptors, and generate AI character models)

You must provide explicit consent by tapping "I Agree & Continue" before any photos are transmitted. If you do not consent, your photos will not be uploaded or processed.

4. Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

5. Data Retention

We will retain your personal information and Input Data only for as long as is necessary for the purposes set out in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Input Data and Generated Content may be deleted according to specific retention schedules or upon your request, subject to technical feasibility and legal requirements.

Some uploads and intermediate processing artifacts are kept only for a limited time to complete generation, retry failed jobs, prevent abuse, and deliver results; we then delete or anonymize them when no longer needed for those purposes, except where a longer period is required by law or legitimate security and fraud-prevention needs.

5a. International Data Transfers

VosuAI is based in the United States and uses cloud infrastructure (AWS) that may store and process your data in the US or other countries. We take steps to ensure your data is protected in accordance with applicable law, including GDPR.

6. Your Data Protection Rights

Depending on your location, you may have the following rights regarding your personal information:

  • The right to access – You have the right to request copies of your personal data.
  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure – You have the right to request that we erase your personal data, under certain conditions. This includes the right to request deletion of your character models and all associated face data.
  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
